These Artificial Intelligence Supplementary Terms (“AI Terms”) form part of the Acceptable Use Policy and any applicable subscription agreements between you and Skeleton Key Pte. Ltd. (“Skeleton Key”), a company incorporated in Singapore (collectively, the “Agreement”). These AI Terms govern your access to and use of any AI features or functionalities within Skeleton Key products and services (“AI Features”). Capitalised terms used but not defined here have the meanings given in the Agreement. Skeleton Key reserves the right to update these AI Terms from time to time.

Definitions

“AI” means any features or functionalities within Skeleton Key products that utilise machine learning models or data models trained by artificial intelligence.

“AI Writing Tools” means AI-powered authorship, editing, and content generation tools available through Skeleton Key products.

“Input” means any data, prompts, text, files, or other materials you provide to AI Features for processing.

“Output” means any content, text, data, or results generated and returned by AI Features based on your Input.

Subscription and Usage Limits

AI Features form part of your selected subscription plan as described on Skeleton Key’s website or in relevant documentation. Unless otherwise specified in your order form or at purchase, the term for any AI add-on aligns with your primary subscription term, including renewals.

Your use of AI Features is subject to usage limits based on your subscription plan. If you exceed permitted usage, Skeleton Key may require you to upgrade your plan or purchase additional credits. Skeleton Key may also limit, disable, or degrade performance of AI Features if usage limits are exceeded.

Use of Data for AI Improvement

1. Use of platform‑generated outputs

Skeleton Key may use platform‑generated outputs (such as research reports, strategy documents, and marketing plans created by Skeleton Key AI agents) to evaluate, improve, and optimize its AI workflows, agents, and service quality, unless the customer has validly opted out. This use is strictly limited to internal quality assurance and system‑performance analysis and does not involve the re‑training, fine‑tuning, or updating of any underlying machine‑learning or artificial‑intelligence models on the basis of customer data.

When platform‑generated outputs incorporated or are derived from personal data within the meaning of the Personal Data Protection Act 2012 (PDPA) of Singapore, this processing is conducted in accordance with the PDPA’s requirements on the lawful collection, use, and disclosure of personal data, including the Transparency and Purpose Limitation obligations under the PDPA and the Advisory Guidelines on the Use of Personal Data in AI Recommendation and Decision Systems issued by the Personal Data Protection Commission (PDPC).

In contexts where EU‑based data subjects are involved, Skeleton Key also endeavours to comply with Regulation (EU) 2016/679 (the GDPR), including the principles of lawful, fair, and transparent processing set out in Articles 5 and 12, and the right to object to processing based on legitimate interests under Article 21.

2. Prohibited uses of user data

Skeleton Key does not use customer inputs, raw user uploads, or personal data to train, re‑train, fine‑tune, or otherwise improve any machine‑learning or artificial‑intelligence models. Skeleton Key does not use raw user data for any purpose other than providing and operating the service as described in this Privacy Policy and any applicable service‑specific terms.

Where platform‑generated outputs are non‑personal or have been processed in a manner that they do not constitute personal data under the PDPA (or “personal data” under the GDPR), Skeleton Key’s use of such outputs for internal quality‑assurance and system‑optimisation purposes does not amount to the use of personal data for AI model training within the meaning of the PDPC’s Advisory Guidelines on the Use of Personal Data in AI Systems or the EU AI Act‑related framework for data used in training AI systems.

3. Opt‑out rights and scope

Customers may opt out of the use of platform‑generated outputs for quality‑assurance and performance‑improvement purposes by adjusting the relevant account settings or by contacting Skeleton Key support. Skeleton Key will implement any valid opt‑out in a manner consistent with its obligations under the PDPA, including the requirement to respect the individual’s right to withdraw or otherwise limit consent where applicable, as well as any applicable cross‑border data‑protection frameworks.

This opt‑out right applies across all subscription plans offered by Skeleton Key, including paid and enterprise tiers, and is not limited to free or trial accounts. When an opt‑out is received, Skeleton Key will cease the use of platform‑generated outputs for the specified quality‑assurance and service‑improvement purposes, in a manner consistent with the PDPA’s accountability and data‑protection‑by‑design expectations.

Input and Output Responsibilities

When using AI Features, you may provide Input for processing and receive Output generated by the AI. Provided you comply with the Agreement, both Input and Output form part of your Customer Content.

You are solely responsible for the development, content, accuracy, legality, and use of your Input and Output. You must ensure that your Input, use of AI Features, and Output do not:

  • violate any applicable laws or regulations in Singapore or other relevant jurisdictions;
  • breach these AI Terms, the Agreement, or Skeleton Key’s Acceptable Use Policy;
  • infringe, misappropriate, or violate the intellectual property rights, privacy rights, or other rights of Skeleton Key or any third party.

You acknowledge that due to the nature of machine learning technology, Output may not be unique. AI Features may generate the same or similar Output for you, Skeleton Key, or other users based on similar Inputs.

Restrictions on AI Feature Use

You must not use AI Features or Output:

  • to develop foundation models, large language models, or other AI systems that compete with Skeleton Key products;
  • to mislead others into believing Output was created entirely by humans without AI assistance;
  • to generate spam, unsolicited communications, or content for electoral campaigns, lobbying, or political advertising;
  • in ways that violate technical documentation, usage guidelines, rate limits, or parameters provided by Skeleton Key.

You must comply with all applicable laws and industry standards when using Output, including providing appropriate disclaimers if Output is used in regulated fields such as medicine, finance, law, or any area where accuracy is critical.

Warranty Disclaimer

TO THE FULLEST EXTENT PERMITTED BY SINGAPORE LAW, SKELETON KEY PROVIDES AI FEATURES AND OUTPUT “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. This includes but is not limited to warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

Skeleton Key does not warrant that AI Features will produce accurate, complete, reliable, or suitable results. Output may contain factual errors, biases, omissions, or inappropriate content despite appearing detailed or authoritative. You must independently verify the accuracy of all Output through fact-checking and professional review before use, especially for critical applications.

AI Features cannot access real-time data and may not reflect recent events or changes. No oral or written information or advice from Skeleton Key creates any warranty beyond these AI Terms.

Service Level Exclusions

Any service level commitments or uptime guarantees in the Agreement do not apply to AI Features. Downtime or performance issues caused by third-party AI providers or underlying models will not count toward service level calculations.

Third-Party Provider Requirements

Skeleton Key AI Features may integrate with third-party AI services such as OpenAI, Anthropic, or others. Your use must comply with those providers’ applicable policies, including content policies, usage guidelines, and terms of service.

You agree to indemnify Skeleton Key against any claims arising from your breach of third-party provider policies or misuse of AI Features that violates those policies.

General Provisions

These AI Terms are governed by the laws of Singapore. Any disputes will be resolved in accordance with the dispute resolution provisions in the Agreement.

Skeleton Key may suspend or terminate your access to AI Features if you violate these AI Terms or the Agreement. Sections that by their nature should survive termination (including disclaimers, indemnities, and restrictions) continue to apply.
